Disclaimers:
Fine Things Packages is a division of Fine Things International, Inc. The
company is a professional service provider that assembles packages for “sold
out” events for its clients and provides representative services to support the
services contracted for. Fine Things is not a ticket broker, travel agent, or
insurance broker. It is not affiliated with any sports organization, sports
league, any box office, hotel, airline, car rental company. Unless specifically
disclosed, Fine Things Packages does not have any relationships (other than
contractual) with any of the service providers who provide services for the
packages sold by the company. Fine Things Packages does not “sell” or broker
individual event tickets, hotel rooms, or flights. It deals at arms length with
such suppliers, seeking to negotiate the best prices on behalf of the company
for inclusion in reasonably priced client packages. It is rare that the company
can acquire tickets and services at “face value” for its packages for “sold out”
events, given the demand for such items by the general public and corporate
purchasers.
Unless specifically agreed in writing, Fine Things’
standard packages do not provide a “fully inclusive” tour package. While Fine
Things will upon request design a “custom package” to cover additional package
options, additional or optional activities not specified in the written contract
are the sole responsibility of Purchaser.
Terms and Conditions:
These terms and contidions set
forth below aer applicable to all clients, partners, agents, associates,
Purchasers, and all other persons who use this web, in consideration of the use
of this web site for any purpose whatsoever.
All sales are subject to written contract:
All purchases of Fine Things Packages (Fine Things) are subject to written
contract (incorporating by reference these conditions stated herein) specifying
all the services to be provided. Fine Things Packages shall be obligated to
provide such services only after the parties have both signed the contract and
Fine Things has received the consideration agreed. If other parties (other than
those specified in the contract) are beneficiaries the Fine Things package
services under the contract, then such other parties shall be subject to all
terms and conditions of the contract, including any disclaimers or limitations
referred to herein. If such other beneficiaries do not adhere to the contractual
terms, than Purchaser shall hold Fine Things harmless for any claims or damages
incurred by Fine Things relating thereto.
Order Confirmation.
Once the signed contract and payment is received, then we will confirm your
order. If you do not receive such confirmation, Purchaser must contact Fine
Things at least five days before the relevant dates in the contract when
services are to commence to confirm the agreement. Failure to do so will
constitute a waiver of all claims relating to Fine Things non-performance of the
agreement.
All Sales are final.
Fine Things purchases (or obligates itself to purchase) the various tickets,
hotel nights and the like, and further performs (or obligates itself to pay for
or perform) all services agreed with Purchaser at the time of contract.
Therefore Fine Things cannot be responsible for any refunds relating to
contracted consideration received herein.
Delivery of Tickets.
In many of our packages, the event tickets (such as Super Bowl tickets) will be
delivered shortly before the event, either by express courier, or in person in
the city where the event will take place. For example, in the case of the Super
bowl, the NFL does not deliver the Super Bowl tickets until shortly before the
game. Delivery will be made to the address on the contract (unless Purchaser
specifies a different address in advance in writing) by an express courier
service such as Federal Express. If tickets for an event are delivered to Fine
Things shortly before an event so that in the opinion of Fine Things it cannot
guarantee that the ticket will reach the client before he or she departs, then
Fine Things will arrange to deliver the ticket personally to client in the host
city prior to
the event.
If you do not receive your tickets at least 2 days prior to
departure, you must call Fine Things at (646)286-9778 or e-mail Fine Things at
www.sales@finethingspackages.com so that we can track your shipment. Fine Things
is not responsible for late deliveries unless we are contacted at least two days
before your departure date to advise us that you have not received your tickets.
If upon delivery of your tickets, you believe that these tickets are not the
same tickets contracted for (i.e. the tickets are in the wrong level or section
or for the wrong date, etc.), then you must contact Fine Things at least two
days before your departure. Failure to do so will constitute acceptance of those
tickets. If you contract with Fine Things shortly before the event, a Fine
Things representative may deliver your tickets to you directly after your
arrival in the host city.
Prices.
Most of our packages have elements whose price may either increase or
decrease the published prices. Accordingly, prices will be negotiated between
the parties at the time of contract. Prices quoted by Fine Things on the web
site or written brochures reflect the current market value when the web site was
last updated or the brochures published. All prices are subject to change at any
time prior to parties signing a written agreement relating to the package. In
fact, as the date approaches for “sold out” event, prices do generally rise,
given the increased demand for the package and tickets. If the prices or
services to be performed are misstated in the contract, due to clerical or
typing error, then Fine Things reserves the right to correct such error, upon
giving notice to the Purchaser of such error, and to decline to provide the
contracted services if such correction cannot be agreed. In such case, any
consideration received by Fine Things would be refunded.
Payments. All payments
are due and payable on the dates and times specified in the parties’ written
agreement. No final itinerary for any package will be issued until all
consideration agreed by the parties is received. If any such contracted payments
are not received when due, then Fine Things will send written notice to the
Purchaser as a reminder that such payments are due and have not been received.
If the Purchaser does not make such payments, or make other arrangements for
payment with the company in writing within 72 (seventy-two) hours following
receipt of such notice, then Fine Things, at its option, may consider the
Purchaser to be in material breach of contract and terminate the contract. In
such an unlikely event, Fine Things reserves the right to retain all
consideration (if any) received from Purchaser as liquidated damages, and in
addition seek any other damages that arise from such breach of agreement.
Nothing in the agreement with Purchaser, including the notice provisions in this
paragraph, shall constitute a waiver of any such claims.
Names of Persons Traveling.
All persons traveling as a Purchaser or beneficiary of a Purchaser with Fine
Things Packages agree to abide by these terms and conditions. Such persons are
identified in the contractual appendices at the time of contract, unless
otherwise agreed in writing by the parties. The exact spelling of the names, as
they appear on government issued identification (driver’s license, passport or
the like) is required in order for the company to execute its contractual
obligations. Time is of the essence. Failure to provide all persons (parties)
names, accurately and on time, may cause Fine Things additional costs, not
anticipated in the contract. Such additional expenses are the responsibility of
the Purchaser, and Fine Things may, at its option, recover such reasonable
additional costs prior to delivering the services affected by the provision of
late or incorrect names as required by contract, or refuse to provide the
services altogether.
Limited Transfer Policy.
Packages are not transferable without the prior written consent of Fine Things,
and then only under exceptional circumstances. In the rare occasion wherein
Purchaser may become ill or otherwise physically unable to attend an event, then
Fine Things authorizes Purchaser to transfer all or part of the Package to a
third party designated by Purchaser, if Purchaser gives written notice that it
intends to do so. Airline tickets are not transferable. Fine Things will provide
reasonable efforts to assist Purchaser in such transfer, but will have no
responsibility for any additional costs or losses to Purchaser associated with
such transfer nor issue any refunds relating thereto.
Transportation.
Prior to departure, Fine Things will provide an itinerary to Purchaser, listing
the relevant times of departure and airline reservations (if any) and for other
contracted transportation (if any). The Purchaser (and other parties included in
the package) is responsible for arriving for departure at such times specified
by transportation provider, and Fine Things will not be held responsible for
Purchaser’s failure to arrive as specified, nor will it issue refunds relating
thereto. (Airlines recommend arrival for departure at least two hours before
departure for domestic flights, and 3 hours for international flights.) Fine
Things shall not be held responsible for damages, for delays, cancellations or
unavailability of public or private transportation caused by an act of God, by
acts of war, riot, civil commotion, by an act of State, by strikes, fire, flood
restricted availability or by the occurrence of any other event beyond the
control of Fine Things.
Rental Cars.
Fine Things will occasionally make reservations for rental vehicles for
Purchasers who contract for them. The reservations for such vehicles will be
made in the name of the Purchaser. The Purchaser assumes all responsibility for
the rental vehicle, including payment of all costs, including provision of
relevant collision and liability insurance, or extra costs relating to gas,
extra hours or extra days rental, and any liability relating to the operation of
the vehicle or otherwise. Customer agrees to properly insure vehicle for any
liability relating to the operation of the vehicle, and will hold Fine Things
harmless for any claim that might be made against Fine Things for any reason.
The principal driver must have a valid driver’s license and major credit card to
rent the car or the customer will be unable to rent the vehicle.
Hotels.
Fine Things identifies the hotels that will be included in its packages in
the contract and in promotional materials. All such services are contracted for
with reputable professional hotel establishments. Purchaser is invited to look
at consumer reviews published on the net before contracting with Fine Things to
include a specific hotel in its package. While Fine Things representatives will
exert reasonable efforts to ensure that the services provided by the hotel are
acceptable to Purchaser, Fine Things will not be responsible for any refunds
relating thereto, unless specifically agreed by Fine Things in writing. Fine
Things reserves the right to upgrade Purchasers reservations at any hotel, or to
make reasonable alternative hotel arrangements for Purchaser if contracted hotel
accommodation is unavailable due to circumstances beyond the control of Fine
Things or for any other reason. Fine Things will make reservations at the hotel
on behalf of customer, and prepay the nights reserved in customer’s name. This
is the extent of Fine Things’ obligation or liability to Purchaser or to Hotel.
Purchaser will require a major credit card upon registration to guarantee
payment of all other hotel charges, such charges being the sole responsibility
of Purchaser, unless otherwise agreed in writing. Purchaser shall be
responsible for any damages made to the rooms that might be claimed by Hotel, or
for injuries suffered by Purchaser’s guests, if any. Purchaser will hold Fine
Things harmless for any such claims. Fine Things has no control over Hotel, nor
does it have any affiliation with Hotel. Purchaser agrees that it will not make
any claims against Fine Things for any reason relating to claims that might
arise relating to its use of the Hotel.
Event Rescheduling.
In the unlikely event that an event is rescheduled for any reason, the event
tickets will usually be valid for the new date. However, Purchaser may be
responsible for additional hotel costs, airline costs, and the like if required
to attend on the rescheduled date. Fine Things will make reasonable efforts to
assist Purchaser to attend on the rescheduled date, including assisting
Purchaser in making reservations for new flights, hotel rooms, car rentals, and
the like, but cannot guarantee their availability. Fine Things will make
reasonable efforts to assist Purchaser to transfer contracted services and their
associated costs to the rescheduled date, but Fine Things will not be
responsible for any additional costs or losses to Purchaser if it is unable to
do so. Fine Things will provide the contracted on-site services and
representative support promised in the contract for the rescheduled date such as
local transportation to the game, pre game drinks, representative support, and
the like. Purchaser assumes the risk of rescheduling any “sold out” event, and
Fine Things will not issue any refunds if Purchaser is unable to attend the
rescheduled event. In this case, it will assist Purchaser if he desires to
transfer all or part of the package to a third party of his or her choice, as
stated above in “limited transfer policy” above.
Event Cancellation.
In the highly unlikely event of cancellation of a “sold out” event, Fine Things
will refund such portions of the consideration paid on the package, as may be
directly refunded to Fine Things (as a result of cancellation) by its own third
party suppliers, and/or direct savings on third party supplier contracts, if
any, resulting from the cancellation. Purchaser assumes the risk of cancellation
and Fine Things refunds will be limited to the provisions herein.
Credit Card Policy.
Fine Things accepts, Discover Card, Master Card or Visa. (Fine Things will
accept payment by Cashier’s Checks up to two days before departure, or Company
check up to five days before departure. Last minute package purchases will be
made only pursuant to bank transfer to our corporate account, unless otherwise
agreed by the parties. Our published prices include a 5% cash discount
that is not applicable to credit card charges. If a credit card is used,
Purchaser agrees that it will not reverse any charges relating thereto, without
the prior written agreement of Fine Things
Passports, Visas, and travel documents. These are the personal
responsibility of Purchaser, and all persons traveling in Package(s), and Fine
Thins shall not be responsible for advising those traveling as to these
requirements, nor will it be responsible to refund any portion of the purchase
price should those contracting for our packaging services be unable to travel as
a result of failure to obtain such required documentation prior to the time of
departure for an event, or otherwise failure to produce such documentation to
authorities when required to enable them to travel . It is highly recommended
that all persons traveling in Packages check with their local government
authorities as to such travel requirements and obtain the requisite
documentation well in advance of their scheduled departure. Once such
documentation is acquired, it is recommended that this be kept in a secure
place, as a lost passport (or visa) is virtually impossible to replace at the
last minute in most countries.
Personal Responsibility for Conduct
Each person traveling with Fine Things is responsible for his or her
own personal conduct. Given the quality of our clients that travel with
us, Fine Things has rarely experienced any problems relating thereto.
However, our service suppliers, including airlines, hotels, transport,
and event managers, reserve the right to exclude such persons from
their flights, accommodations, transport vehicles, and events if in the
opinion of those responsible for public safety, security, and protecting
the rights of others attending an event, the personal conduct of the person
poses a danger to others, or to themselves. In such event, Fine Things will not
be responsible for any refunds or damages, and Purchaser agrees to hold Fine
Thing harmless for any such claims.
Legal Responsibility for Damages Claimed.
Fine Things is a contractual packager of services for Purchasers to selected
“sold out” events world-wide. It has no affiliation or relationship with any
service provider in its packages or any control over such providers. Purchaser
agrees that the purchase of such package is for the personal use of the
Purchaser or “other persons” accompanying them or receiving benefit of such
packaging services as agreed in the contract, and not for any commercial purpose
whatsoever other than that disclosed in the contract. Purchaser accepts that the
extent of Fine Things liability to Purchaser is to contractual claims relating
to the delivery of the package as agreed. Purchaser and other persons benefiting
from Purchasers contract agree that they will not make any claims for damages
under any other theory of law, be they related to lost business opportunity,
personal injury, wrongful death, emotional distress, or the like, but will limit
its claims to replacement costs or actual costs for specific parts of the
package that were not delivered. Purchaser agrees to hold Fine Things
harmless for any such claims that might exceed this limitation of damages
Dispute Resolution:
Arbitration.
The parties agree that all disputes between Fine Things and Purchaser (or other
persons benefiting from the Package) arising from this agreement under any
theory of law will be arbitrated pursuant to the Uniform Arbitration Act of
Montana in Billings, Montana. The applicable procedural and substantive law will
be the law of Montana without regard to conflict of law principles. In the case
where a client shall reverse charges on a credit card, cancel a check given for
payment, or be a no show for an event where promised payment was not made, or in
any other instance where contracted payment was not made in a timely manner,
resulting in damages to Fine Things, Purchaser agrees to pay all arbitration
costs and reasonable attorney fees relating to the arbitration proceedings, and
the enforcement of any award.
General:
Entire Agreement.
Fine Things shall provide a written contract for its services rendered. That
contract shall incorporate all terms and conditions stated herein by reference,
and shall constitute the entire agreement between Fine Things and Purchaser.
Other than those expressly contained in the contract, no representations or
warranties (either expressed or implied) are given to purchaser. The contract
shall supersede any prior understanding or agreement (whether written or oral)
regarding the subject matter, and may not be amended or modified except in
writing or by making such amendments of modifications available on this site.
Trademark Policy.
Fine Things International, Inc, Fine Things Packages, Fine Things Art and
Antiques, “A Leap from the Ordinary!” are all registered and/ or unregistered
trademarks of Fine Things International, Inc. in the United States of America,
and internationally. Fine Things International, Inc.’s trademarks may not be
used in any manner that disparages or discredits the company, or otherwise
causes Fine Things International, Inc. economic damage. All other trademarks
used on this site are not owned by Fine Things, but are the property of their
respective owners.
Copyrights and Limited License to Use the Site.
This entire site and the information contained herein are copyrighted. Fine
Things International, Inc. grants a limited license to access and make personal
use of this site and not to download (other than page caching or where
authorized on the site) or modify it, or any portion of it, except with express
written consent of Fine Things International. This license does not include any
resale or commercial use of this site or the contents, any collection and use of
any information, descriptions, or prices, any derivative use of this site or it
